Terms and Conditions

Any order, request or purchase of products from Benjamin Black Ltd ("Goldsmiths" or “Benjamin Black”) or any use of this website, the purchaser ("you”, “your” or “customer"), acknowledges and agrees to the following terms and conditions of sale shall apply.

Our promise to you
Every Benjamin Black piece is made to the highest standard of workmanship and design. Our trade-certified manufacturing jewellers adhere to strict quality control procedures. With proper care and maintenance, your Benjamin Black jewellery will last for a lifetime and beyond. Please be aware that the quality of the stones and metal selected will determine the wearability and durability of your piece.

The ‘Gallery’
All pieces on the ‘Gallery’ section of the website are examples of custom-made specifically for a client or are available now for purchase from the Benjamin Black Goldsmiths Studio.

Ordering a custom-made piece
Benjamin Black specialises in custom-made jewellery, which is made to your individual requirements. If you order a custom-made piece from Benjamin Black, we strive to ensure no other piece will be made exactly the same as your piece. Similar pieces can be created upon request. If a similar design is requested by another customer, we will ensure at least one differing element is incorporated, such as different stones, metals, finishes or designs.

Copyright and intellectual property rights, which include the rights relating to the design and manufacture of a custom-made jewellery piece always belong to Benjamin Black, notwithstanding you have paid Benjamin Black Limited to design and create your jewellery piece.

Benjamin Black Goldsmiths requires a minimum 25% deposit upon placing an order for a custom-made jewellery piece. Further, items required to make your piece which are to be acquired on your behalf must be paid for in advance, (for example, diamonds for your ring). The finished piece and ownership will pass to you when the full payment has been received by Benjamin Black.

For custom-made jewellery, the deposit paid is non-refundable if you change your mind about proceeding with the custom-made jewellery.

Ring resizing
Every ring purchased from Benjamin Black comes with a complimentary ring resizing - up to two sizes up or down - within one month of the purchase date, or as otherwise arranged.

GST (Goods and Services Tax)
For New Zealand delivery addresses, all prices are New Zealand GST inclusive (at a GST rate of 15%) unless otherwise stated. If your order ships to a delivery address outside New Zealand, no GST will be charged.

Courier charges
International shipping is $150 NZD, unless otherwise specified or arranged with you. All packages are tracked with a signature required upon delivery.
We are unable to send orders to a PO Box address.
Shipping within New Zealand to urban addresses is free of charge.

Customs and duties
For any orders shipped to an address outside of New Zealand the customer is the importer of record and will be responsible for all customs import duties and any local sales tax charges. These charges vary in each country and are outside of Benjamin Black’s control. Contact your local customs office for more information on what import duties or sales taxes may be imposed.

Delivery estimates
All orders sent within New Zealand are targeted for delivery between 3 and 5 working days. Orders shipped outside of New Zealand normally take up to 10 working days.

Benjamin Black makes every effort practical to ensure that the delivery timeframes given are accurate. However, the estimated delivery times assume no unforeseen events. By placing an order, you agree not to hold Benjamin Black liable for any loss or damage directly or indirectly arising out of or in connection with any delay or failure to deliver within the estimated time frame.

Insurance
Please contact your insurance company to have your Benjamin Black jewellery insured before your jewellery leaves Benjamin Black’s premises as your jewellery is not insured by Benjamin Black once it leaves Benjamin Black’s premises. We can organise independent registered valuations on your behalf to assist in ensuring your jewellery is insured for the correct value.

Addressing
If an order/s is found to be incorrectly addressed by Benjamin Black then Benjamin Black will be responsible for the re-delivery, replacement or refunding of the item(s). If the customer is found to have given an incorrect or insufficient address, Benjamin Black will not refund or resend the product. All responsibility and associated costs for correcting delivery will be borne by you.

Returns Policy

1: Returns on stock jewellery i.e. directly purchased from the Benjamin Black store:
If you are not satisfied with the items you have ordered, please email us and let us know the reasons for your dissatisfaction. If you return your order to us within ten days of receipt, unused, with the goods undamaged and in their original packaging, we will be happy to offer a full refund or exchange the goods for other items.

Please Note:

  • We will only accept goods returned with prior notification within ten days of receipt through correspondence with our sales team.

  • All returned goods must be sent to Benjamin Black Goldsmiths premises.

  • The original invoice/receipt must accompany the returned item.

  • We can only accept items returned if they are within the original packaging.

  • Courier/airmail and/or credit card charges will not be refunded.

  • We strongly advise all customers to check goods thoroughly upon delivery.

    2 : Returns on custom-made jewellery i.e. jewellery made to individual order:
    If you are not satisfied with the items you have ordered, please email us and let us know the reasons for your dissatisfaction.

    Due to the individual needs of each client, and the personalisation that goes into the creation of a custom-made piece, we cannot guarantee a full refund on a custom-made product. However, we will work with you to try and arrive at an amicable solution in accordance with our terms and conditions and New Zealand Law.

Receiving a refund
Once your order has been returned to us within the above stated time frame, and if agreed to by Benjamin Black, we will begin to process your refund request. Each item will undergo a quality control check and once verified, your refund will be processed in the original payment format as your purchase was made within 30 days of the date of cancellation notice. All undamaged, correctly returned products will be credited to the original purchaser’s bank account, including GST where applicable. Please note that your bank institution may require additional days to process and post the transaction to your account once they have received the information from Benjamin Black.

Further, only items which Benjamin Black can confirm as new and unused will be eligible for a refund or exchange, so that they have reached our returns department within the time frame outlined above, unless otherwise arranged with and agreed to by Benjamin Black. If we receive your returned goods in a condition which we consider is not fit for exchange or refund we shall get in touch with you. Benjamin Black reserves the right to refuse a refund for any item sent back in a condition where the item has been used or damaged.

Limitation
Benjamin Black’s liability for any loss or damage of any kind arising from the supply of goods or services is limited to the price paid for the goods or services. You shall indemnify Benjamin Black against all claims and losses of any kind whatsoever that has any correlation to the supply of or provision of any goods or services.

New Zealand law
All goods or services supplied or sold by Benjamin Black, are subject to the laws of New Zealand. The laws of any other country shall not apply between you and Benjamin Black.

Please note:
Where the provisions of the Consumer Guarantees Act 1993 apply, these terms will be read subject to the application of that Act, and in the case of any conflict, the provisions of that Act will apply.

The Consumer Guarantees Act 1993 does not apply to business customers (where "business" is as defined by the Act). Business customers agree that where products are purchased for the purpose of a business that the Act does not apply.
